Rauf Khan Wazir v. Government of Pakistan,
PLC (C.S) 2012 493 · Balochistan High Court
This case involved a candidate who took the 2009 Central Superior Services (CSS) examination and ranked 21st on Balochistan's merit list. When a higher-ranked candidate declined a position in the Military Lands and Cantonment Group, the petitioner argued he should have been offered that vacant post instead of having it carried forward to the next year's exam, as permitted under Rule 7 of the FPSC Competitive Examination Rules 2009.
The Balochistan High Court dismissed the petition. It found that the petitioner had not even completed the mandatory Common Training Program, and more importantly, he had unreasonably delayed nearly five months before challenging the decision, despite knowing about it. The court also noted that six other candidates who had taken the CSS exam the following year had a legitimate expectation of being considered for that same carried-forward vacancy, since results had already been published in newspapers before the petitioner filed his case. The petitioner failed to include these affected candidates as parties to his case, which was a procedural flaw. Given these facts, the court held that the government's decision to carry the vacancy forward was neither illegal nor unlawful.
This case matters because it illustrates how courts weigh delay and failure to involve all affected parties when deciding whether to intervene in civil service recruitment decisions, even when procedural rules are cited in support of a claim.
