Muhammad Hassan Baloch v. Director Manpower Training,
PLC (C.S) 2012 1530 · Balochistan High Court
This case is about a government employee's right to keep living in an official residence after a department was split into two.
Muhammad Hassan Baloch was allotted a bungalow in Quetta in 1994 while working in the Labour and Manpower Department. Later, that department was bifurcated (divided) into separate departments, and he ended up working for one of the new departments while the property came under the control of the other. Authorities then ordered him to vacate, and the bungalow was allotted to someone else (respondent No. 2). Baloch sued, arguing he remained the lawful allottee and could not simply be evicted without due legal process. The trial court and the appellate court both dismissed his case, saying he had no cause of action.
The Balochistan High Court disagreed. It held that mere administrative bifurcation of a department does not automatically strip an employee of his lawful allotment status. The authorities, as owners, could reclaim the property, but only by following proper legal procedure - not by unilateral notice. The court declared that the letter demanding vacant possession and the fresh allotment to respondent No. 2 had no legal effect, and set them aside.
This matters because it reinforces that government employees have legal protections against arbitrary eviction from official housing, and that administrative reorganizations cannot bypass due process.
