Sher Ahmed v. Khuda-e-Rahim,
PLC (C.S) 2012 142 · Balochistan High Court
This case involved a double murder allegedly committed over an accusation of "siyahkari" (a so-called honour-related allegation). Back in 1999, the accused, Khuda-e-Rahim, along with others, was tried in absentia by a Special Judge under the Suppression of Terrorist Activities (Special Courts) Act, 1975, and convicted with a life sentence. About eleven years later, the accused applied to a Sessions Judge to set aside that conviction, arguing the in-absentia trial was flawed. The Sessions Judge agreed, cancelled the conviction, and ordered a fresh trial.
The murder victim's maternal uncle challenged this before the Balochistan High Court, arguing the Sessions Judge had no authority to pass such an order. The High Court found that the original trial in absentia was indeed defective, since there was no proof that the required newspaper proclamations summoning the accused had actually been published, as the law demanded. However, the Court also ruled that the Sessions Judge lacked jurisdiction to decide the matter, because the 1975 law had since been repealed and replaced by the Anti-Terrorism Act, 1997. Since the case involved a scheduled terrorism-related offence, it should instead go to the Anti-Terrorism Court.
The Court also strongly condemned honour killings, stating that neither law nor religion permits such acts, and that they violate constitutional protections of life and dignity. It set aside the Sessions Judge's order and directed that the case be transferred to the Anti-Terrorism
