Jamaluddin v. Chief Justice Balochistan High Court,
PLC (C.S) 2012 1311 · Balochistan High Court
This case concerns a subordinate judiciary officer, Jamaluddin, who was reverted from the post of Senior Civil Judge to Judicial Magistrate and had his promotion withheld for three years through an order dated 21 July 2009 (notified 27 July 2009). He challenged this action before the Balochistan High Court, arguing he was never informed of the disciplinary proceedings against him, only learned of the penalty in early 2010, and was thus condemned without a fair hearing. He also argued the punishment was too harsh for what he called a minor procedural lapse in handling a confessional statement.
Before addressing these merits, the court first had to decide whether his departmental representation had been filed within the legally allowed time. Under the applicable rules, an employee has 60 days to file such a representation. The court found that Jamaluddin's application was filed roughly five months late, and that he gave inconsistent and unsupported explanations for the delay, failing to prove he genuinely lacked knowledge of the order earlier.
Because he could not justify the delay, the court held his representation was time-barred and upheld the department's rejection of it, dismissing his appeal without examining the substantive fairness of the reversion order.
This case illustrates how procedural deadlines for administrative appeals can prevent courts from even considering whether a punishment was justified, underscoring the importance of civil servants acting promptly when challenging adverse orders.
