Mst. Kubra Khanum v. Anjuman-e-Imamia Assn-e-Ashria,

PLC (C.S) 2012 106 · Balochistan High Court

This case involved a dispute over two shops located within Punjabi Imam Bargah on Alamdar Road, Quetta. The shops had been rented out long ago, and after the original tenant died, his heirs (the appellants) continued as tenants. The landlord, a registered religious organization managing the Imam Bargah, filed for their eviction, arguing that the tenants had defaulted on rent for years and that the organization genuinely needed the shops to expand space for religious gatherings (majalis and mahafil) and to accommodate pilgrims (za-e-reen) traveling to shrines in Iran, Iraq, and Syria. The Rent Controller ordered eviction, and the tenants appealed, claiming they weren't given a fair hearing and that the landlord didn't really need the shops.

The Balochistan High Court dismissed the appeal and upheld the eviction. It found that the landlord's need was genuine and supported by evidence, and the tenants failed to disprove this. The court also rejected the claim of unfair hearing, noting the tenants had actually been given multiple opportunities to argue their case. Importantly, the court held that property ownership rights, protected under Articles 23 and 24 of the Constitution, are superior to tenancy rights, meaning tenants cannot dictate whether a landlord's need for the property is sufficient. This case reinforces that landlords' bona fide personal need, especially for religious or charitable purposes, can override tenant occupancy, provided it is properly proven in court.
