Dr. Saba Durrazai v. Chairman House Allotment Committee/Secretary S&GAD Government of Balochistan,
PLC (C.S) 2011 988 · Balochistan High Court
This case involved a dispute over a government-allotted residence in Quetta. Dr. Saba Durrazai had been officially allotted a house in May 2010, after it was cancelled from its previous occupant, Abdul Sattar Khajak. However, even after retiring, Khajak was allowed to retain the house for six months. When that period ended, instead of the house being handed over to Dr. Durrazai as the lawful allottee, the authorities extended his retention for a further year. She challenged this extension in the Balochistan High Court, arguing it violated the rules governing residential allotments and that as the rightful allottee she was entitled to possession.
The High Court did not rule on the merits of her claim. Instead, it dismissed the petition on a technical ground: under the Residential Accommodation at Quetta (Procedure for Allotment) Rules, 2009, an aggrieved person has the right to appeal an allotment-related order to the House Allotment Committee before going to court. Since Dr. Durrazai had not first used this internal appeal process, the court held that she had an adequate alternate remedy available, and that the High Court could not exercise its special constitutional jurisdiction while such a remedy remained unused.
This case illustrates an important principle in Pakistani administrative law: courts generally require people to exhaust available internal or departmental appeals before seeking judicial intervention, ensuring disputes are first addressed through proper administrative channels.
