Muhammad Ali Satakzai v. Appointing Authority of the Addl. D&S Judges,
PLC (C.S) 2011 78 · Balochistan High Court
This case is from the Balochistan High Court and deals with how judges of the rank of Additional District and Sessions Judge should be appointed. A group of petitioners, who were working on an ad hoc basis in that post, challenged a letter through which the Balochistan Public Service Commission had invited applications, conducted tests, and interviews for these judicial posts. They argued that the Commission had no constitutional authority to be involved in appointing judicial officers, since this power under the applicable service rules conflicted with Article 175 of the Constitution, which requires separation of the judiciary from the executive. The petitioners also asked the court to regularize their ad hoc appointments.
The court agreed that letting a government-influenced body like the Public Service Commission control appointment of judges undermines judicial independence and lowers the dignity of judicial office. It held that under the Constitution, such appointments should instead be handled directly by sitting judges of the High Court, not the Commission. As a result, the letter sent to the Commission for recruiting these judges was declared legally ineffective.
However, the court rejected the request for regularization of ad hoc appointments, ruling that no rule allowed automatic confirmation of ad hoc judicial officers, and that ad hoc service does not create any right to permanent appointment, seniority, or promotion.
This judgment matters because it reinforces the principle of judicial independence by removing executive-controlled bodies from the process of appointing judges.
