Qaisar Khan v Chief Secretary,

PLC (C.S) 2011 1387 · Balochistan High Court

This case was brought by employees of the Balochistan High Court, working as Private Secretaries and Readers, on behalf of the Court's establishment staff. They asked the court to declare it illegal and discriminatory that the provincial government had refused to pay them a Special Judicial Allowance equal to three times their initial basic pay, backdated to 1 July 2009, even though similar staff at the Supreme Court, Federal Shariat Court, and the High Courts of other provinces (Sindh, Punjab, Khyber Pakhtunkhwa) had already received this allowance from that date. The provincial government resisted, citing financial constraints and the province's poor fiscal position.

The Balochistan High Court ruled in favour of the petitioners. It held that denying the allowance to Balochistan High Court staff, while granting it elsewhere, amounted to unjustified discrimination under Article 25 of the Constitution, which guarantees equal treatment to persons similarly situated. The court said financial difficulty cannot override constitutional guarantees of fundamental rights, and that arbitrary or unreasonable distinctions between similarly placed employees are unconstitutional. It directed the government to pay the Special Judicial Allowance to Balochistan High Court establishment staff at the same rate and from the same date as other courts, and to issue the necessary notification.

The case matters because it reinforces that budgetary excuses cannot justify unequal treatment of government employees performing similar roles across provinces.

بلوچستان ہائی کورٹ نے درخواست گزاروں کے حق میں فیصلہ دیا۔ عدالت نے قرار دیا کہ بلوچستان ہائی کورٹ کے عملے کو یہ الاؤنس نہ
