Zafar Masood v. Chief Secretary Govt: of Balochistan,
PLC (C.S) 2010 563 · Balochistan High Court
This case concerns a dispute among civil servants in Balochistan over their seniority ranking. After an earlier ruling by the Balochistan Services Tribunal, the Provincial Selection Board was told to redo the seniority list properly, considering relevant rules and appointment dates. A final seniority list was issued in March 2009, listing the petitioners favorably. However, some other officers (the private respondents) felt the list ignored their claims, so they appealed to the competent government authority. That authority agreed with them and issued a corrigendum in November 2009, revising the seniority list in their favor. The original petitioners then challenged this corrigendum in the High Court, arguing it was issued in bad faith and violated the Tribunal's earlier directions.
The High Court disagreed. It clarified that the Tribunal's earlier ruling had not favored any specific individual—it simply required the Board to follow proper procedure. Since the revised list was the result of a lawful appeal process available to civil servants, and since disputes over service seniority fall under matters that must go to the Service Tribunal (not the High Court) due to Article 212 of the Constitution, the High Court ruled it had no jurisdiction to hear the case. The petition was dismissed without examining its merits.
This case highlights an important principle: seniority and service-related disputes among civil servants must be resolved through the proper appellate channel—the Service Tribunal—not through the High Court's constitutional jurisdiction.
