Chief Executive Officer QESCO and another V. Azizullah, Commercial Superintendent and 3 others,

PLC 2020 96 · Balochistan High Court

This case is about a dispute between QESCO (Quetta Electric Supply Company) and three of its employees, working as Commercial Superintendents, over pay upgradation. The employees had been promoted through the ranks over decades of service and, based on an official government memorandum dated 22 April 2013, claimed they were entitled to a two-step time scale up-gradation. This memorandum stated that employees in a certain pay grade (BPS-15) should receive this benefit. When QESCO did not grant it, the employees filed a grievance, which was upheld by the Labour Court and then by the Labour Appellate Tribunal. QESCO challenged both rulings before the Balochistan High Court.

The High Court dismissed QESCO's petition. It found that QESCO had failed to produce any documentary evidence to counter the employees' claim, relying only on a verbal statement from a company representative. Although QESCO cited other official memorandums in its written defense, it never actually proved them in court, and the law requires documents to be properly proved, not just mentioned in pleadings. Since the employees met the qualifications set out in the 2013 memorandum, the court held they were rightly entitled to the upgradation.

This case matters because it reinforces a basic evidentiary principle: government departments cannot simply assert facts or cite documents in written statements—they must formally prove them in court, or risk losing the case, even against their own employees.

ہائی کورٹ نے کیسکو کی درخواست مسترد کر دی۔ ع
