PLC 2017 148 · Balochistan High Court

This case involved five men convicted by an Anti-Terrorism Court in Quetta and sentenced to life imprisonment for allegedly kidnapping a six-year-old boy for ransom, an offense under Section 365-A of the Pakistan Penal Code combined with terrorism charges under the Anti-Terrorism Act. The prosecution claimed the child was abducted by two unknown men and later recovered from the accused's house during a police raid.

The Balochistan High Court overturned the convictions and acquitted all five appellants, finding the prosecution's evidence riddled with gaps and contradictions. The complainant could not specify the phone number, amount, or timing of the alleged ransom demand, and his account was based on secondhand information from his brother, who was never called as a witness. The recovered child's own statement did not name the accused as culprits, and it was recorded six days after his rescue without explanation for the delay, while the accused were denied a chance to cross-examine him. Police witnesses gave conflicting accounts of the raid, no independent witnesses from the neighborhood were involved, and the accused turned out to be close relatives of the complainant who regularly visited each other's homes.
