Habib Bank Limited through President and 2 others V. Aziz Ullah Laghari and 2 others,

PLC 2016 237 · Balochistan High Court

This case involved a Habib Bank employee, Azizullah Laghari, who was accused of fraud, misappropriation, and causing financial loss to the bank. The bank suspended him, held departmental inquiries, and eventually compulsorily retired him as punishment. Separately, a National Accountability Bureau reference was filed against him in the Accountability Court, where he was treated as an approver and acquitted. Based on this acquittal, the Labour Court and the Labour Appellate Tribunal ordered his reinstatement, though without back benefits. The bank challenged this before the Balochistan High Court, arguing that acquittal in a criminal case should not automatically wipe out the findings of independent departmental proceedings, and that the lower courts had wrongly conflated the two.
