Habib Bank Ltd v. Abid Hussain,
PLC 2012 62 · Balochistan High Court
This case involved a dispute between Habib Bank Limited and its former employee, Abid Hussain, over the legality of his termination from service. The bank had terminated Hussain's employment while he was in jail facing a criminal case, without issuing a show-cause notice or holding any inquiry. Hussain challenged this termination before the Labour Court, which ruled against him partly on grounds of delay in filing his grievance petition. However, the Labour Appellate Tribunal later overturned that decision, ordering his reinstatement with back-benefits and setting aside the termination order. The bank then challenged the Tribunal's ruling before the Balochistan High Court.
The bank argued that Hussain's grievance petition was filed beyond the legally allowed time limit under the Industrial Relations Ordinance, and that since his termination was a straightforward termination (not a punishment for misconduct), no show-cause notice or inquiry was legally required. Hussain's side argued that he was terminated while still in jail, was never properly informed of the outcome of his grievance, and that basic principles of fairness required he be heard before such action was taken.
The court examined relevant law under the Industrial and Commercial Employment Ordinance, 1968, particularly the provisions dealing with termination simplicitor (termination without misconduct allegations). It clarified that in such cases, only one month's notice or pay in lieu of notice is legally required, not a show-cause notice or formal inquiry. This case matters because it clarifies employers' obligations when ending employment without alleging wrongdoing
