Balochistan Engineering Works Limited V. Jalal Khan,
PLC 2012 161 · Balochistan High Court
This case involved a worker, Jalal Khan, whose employment with Balochistan Engineering Works Limited was terminated in 2004 after he reached the age of 55, in accordance with a retirement clause in his original appointment letter from 1991. Khan challenged the termination, arguing he was still fit to work, that he had not actually reached 55, and that no law required retirement at that age. The Labour Court initially dismissed his case, and after an earlier round of appeals and a remand for fresh hearing, the Labour Court again ruled against him, prompting appeals to the Balochistan Labour Appellate Tribunal from both Khan and the company.
The Tribunal upheld the Labour Court's decision. It found that although the Industrial and Commercial Employment (Standing Orders) Ordinance, 1968 does not itself fix any mandatory retirement age, Khan had voluntarily accepted a contractual term at the time of hiring stating he would retire at 55. Since this term did not violate any provision of the Standing Orders, and Khan had accepted and acted under it for years, he could not later dispute it. The Tribunal distinguished the case law cited by Khan's lawyer, finding those precedents dealt with different facts, such as attempts to strip workers of pre-existing rights through later agreements, which was not the situation here.
The case matters because it confirms that a validly agreed contractual retirement age, even without statutory backing, is enforceable and binding on the employee who accepted it.
