Abdul Khaliq V. Government of Balochistan through Chief Secretary, Civil Secretariat and 3 others,
PLC 2011 286 · Balochistan High Court
This case was decided by the Balochistan Service Tribunal. Abdul Khaliq, a government school teacher who had earned his B.A. and B.Ed. degrees, challenged a government notification that changed the promotion rules for Secondary School Teachers. Under the original rules, half the promotion posts were to go to qualified subordinate staff based on seniority and merit, judged on a province-wide basis. The new notification restricted eligibility to teachers who had served continuously for three years within the specific district where a vacancy existed, ranked by district-based seniority rather than provincial seniority.
The appellant argued this change was designed to favor certain favored individuals ("blue-eyed" candidates) by letting less experienced or less qualified teachers jump ahead simply because they happened to be posted in the right district, while sidelining more deserving, senior candidates like himself.
The government argued the Tribunal had no power to examine the validity of such rules since that was a constitutional matter beyond its jurisdiction.
The Tribunal rejected this objection, ruling that it does have the authority to examine whether departmental service rules are lawful, especially when they affect civil servants' fundamental rights and terms of service. It found the amended rule unreasonable, made in bad fainted faith, and inconsistent with the purpose of the law authorizing it. As a result, the Tribunal declared the notification invalid and struck it down.
This case matters because it confirms that service tribunals can review and invalidate discriminatory or arbitrary civil service rules that unfairly affect employees
