Muhammad Ikhlas V. The State,

PCrLJ 2025 57 · Balochistan High Court

This case involved Muhammad Ikhlas, who was convicted for allegedly attacking and injuring a complainant and his companion during a fight, facing charges including attempted murder and rioting under the Pakistan Penal Code. He appealed his conviction to the Balochistan High Court.

The court overturned the conviction, finding multiple serious problems with the prosecution's case. First, there was an unexplained ten-hour delay in filing the police report (FIR), even though the police station was only about a mile and a half from the crime scene. The court noted such delays often allow time for complainants to falsely add names to a case, and indeed the accused's brothers had been named but were acquitted at trial. Second, medical evidence contradicted witness testimony about how and when injuries occurred. Third, there was an unexplained one-day delay in recording the injured witness's statement, which courts treat as seriously undermining reliability. Fourth, the key eyewitness behaved unnaturally—claiming to have witnessed the attack yet not taking the injured for treatment or promptly reporting the crime, and his account didn't match hospital records. Fifth, this witness had no credible reason to be present at the scene. Finally, the prosecution failed to produce another witness without explanation, which the court said should be held against it.

Given these cumulative doubts, the court ruled the prosecution failed to prove guilt beyond reasonable doubt and acquitted the appellant, reinforcing that shaky evidence and unexplained delays can be fatal to criminal cases.
