Mehmood Khan Achakzai V. The State and another,

PCrLJ 2025 492 · Balochistan High Court

This case is about whether a criminal case (FIR) filed against Mehmood Khan Achakzai, a sitting National Assembly member and political party leader, should be cancelled. The complainant had alleged that unnamed family members of the petitioner had illegally occupied a government residential plot, and authorities recovered possession in March 2024. However, the FIR was registered five years after the original complaint was made to land authorities, and it did not even name the specific family members supposedly involved, let alone accuse the petitioner directly.

The Balochistan High Court examined the relevant criminal trespass laws and found that the property was merely a residential plot, not a "house," so charges of house-trespass did not apply. It also found that the FIR failed to show any intent by the petitioner to commit an offence or to intimidate, insult, or annoy the person in possession of the property, which is required to prove criminal trespass. Since no evidence supported these essential elements, and the case appeared to be based on vague allegations with an unexplained five-year delay, the court ruled that continuing the trial would be pointless and an abuse of court process.

The court quashed the FIR and declared the resulting proceedings against the petitioner unlawful. This case matters because it reinforces that courts can step in early to stop unfounded criminal cases from proceeding, protecting individuals from harassment through weak or belated prosecutions, especially when legal elements of the alleged crime are clearly missing.
