Munir Ahmed V. The State,

PCrLJ 2024 772 · Balochistan High Court

This case involved a man convicted and sentenced to death by an Anti-Terrorism Court in Pishin for the kidnapping, murder and attempted sodomy of a ten or eleven-year-old boy who had gone missing in 2019. The accused was convicted under multiple sections of the Pakistan Penal Code and the Anti-Terrorism Act, with the trial court also awarding ten years imprisonment for attempted unnatural offence.

On appeal to the Balochistan High Court, the convict argued he was actually a juvenile at the time of the crime, and that the state-appointed defence lawyer at his trial had failed to properly represent him by not cross-examining prosecution witnesses, and that no inquiry into his age had ever been conducted.

The High Court agreed this was a serious failure of due process. It held that when there is conflicting evidence about a person's age, medical opinion should generally be preferred. It also emphasized that lawyers appointed at state expense owe the same duty of diligent representation as any other counsel, and that an accused's right to a fair, properly prepared defence is constitutionally protected.

As a result, the Court set aside the conviction and death sentence entirely and sent the case back to the trial court. It ordered that the accused be given a genuine opportunity to choose his own lawyer or have a senior lawyer appointed, that witnesses be recalled for proper cross-examination, and that a formal inquiry into his age be held under the Juvenile Justice System Act before the trial continues.
