Muhammad Anees and another V. The State,
PCrLJ 2024 1660 · Balochistan High Court
This case involved two brothers, Muhammad Anees and another man, who were convicted of possessing narcotics - 800 grams of ice (crystal meth) and 450 grams of charas - allegedly recovered from a residential house. They appealed to the Balochistan High Court against their conviction.
The court overturned the conviction and acquitted the appellants. It found several serious flaws in the prosecution's case. First, there was no proof the accused actually owned or occupied the house where the drugs were found, and witnesses admitted other people also lived there, meaning conscious possession was never established. Second, the story itself was implausible: police claimed both brothers together tried to hide a small bag of drugs in the bathroom, but no witness explained which one did it, and it seemed physically odd for two people to jointly hide one small bag. Third, no independent witnesses from the neighborhood were included during the raid and arrest, despite people being available nearby, raising doubts about transparency. Fourth, there were contradictions among police witnesses, suggesting a sloppy investigation. Finally, police failed to obtain a search warrant for the house as generally required by law, despite having prior information and time to get one.
This judgment matters because it reinforces important safeguards in narcotics cases: police cannot convict someone merely for being present near drugs, must prove actual ownership or control, should involve independent witnesses, and must follow proper search procedures to prevent false implication.
