Asif Khan V. Anti-Terrorism Court, Dera Allah Yar and another,
PCrLJ 2023 Note 40 · Balochistan High Court
This case was about which court should hear a kidnapping-for-ransom case: a special Anti-Terrorism Court or an ordinary criminal court. The petitioner, Asif Khan, was accused along with others of forcibly abducting two men from a house in Jhal Magsi district while armed with rocket launchers, demanding a ransom of two million rupees. After the police completed their investigation and the case went to the Anti-Terrorism Court for trial, Khan asked that court to send the case to an ordinary court instead, arguing it did not qualify as terrorism. The Anti-Terrorism Court rejected his request, so he challenged that decision before the Balochistan High Court.
The High Court upheld the lower court's decision. It explained that to decide which court has jurisdiction, judges must look tentatively at the FIR, investigation report, and the final police report. Here, the complainant's FIR described an armed abduction for ransom, and the victims themselves, in statements given to police and a magistrate, confirmed they were kidnapped for ransom. The court held that such facts fall squarely within the legal definition of kidnapping for ransom under the Anti-Terrorism Act, which the law specifically assigns to Anti-Terrorism Courts rather than regular courts. The petition was therefore dismissed.
This case matters because it clarifies how courts determine jurisdiction in kidnapping-for-ransom cases, reinforcing that such offenses are treated as terrorism-related and must be tried exclusively in Anti-Terrorism Courts.
