Meer Muhammad V. The State,

PCrLJ 2023 885 · Balochistan High Court

This case is from the Balochistan High Court, deciding an appeal by Meer Muhammad against his conviction for murder (qatl-i-amd), abetment, and acting with common intention under the Pakistan Penal Code. He had allegedly fired at the deceased on the instigation of a co-accused.

The court examined the evidence of the complainant and two eye-witnesses, who were cousins of the deceased, and found it unreliable for several reasons. The witnesses' conduct was unnatural: instead of taking the dead body and injured person to the hospital themselves, they simply waited at the scene for Levies officials. The FIR was lodged with an unexplained delay of seven hours and forty minutes, despite the witnesses supposedly being present at the scene, suggesting it was prepared only after consultation rather than being a spontaneous report. The complainant did not even name the eye-witnesses in the FIR, and the two eye-witnesses' statements contradicted each other and failed to mention each other's presence. The court also found it implausible that the accused would spare the eye-witnesses, who were unarmed and defenseless, while killing their cousins with whom there was no clear motive.

Based on these doubts, the court held that the prosecution failed to prove the case with reliable, trustworthy evidence and gave the accused the benefit of the doubt, allowing the appeal and setting aside the conviction. The case highlights how courts scrutinize witness credibility, delays, and inconsistencies to prevent wrongful convictions.
