PCrLJ 2023 769 · Balochistan High Court
This case involved appeals and a murder reference arising from the killing of a mother and sister of the complainant, allegedly shot by the accused. The prosecution's case relied on eyewitness testimony from the complainant, the brother of one deceased, and the complainant's uncle.
The Balochistan High Court found serious problems with this evidence. The eyewitnesses' statement was recorded at a hospital three hours and fifteen minutes after the killing, not at the crime scene, with no explanation for the delay. The investigating officer, who reached the scene first, never mentioned the eyewitnesses being present. Call Detail Records contradicted their claimed presence, and both witnesses actually lived in another province, 350 kilometers away, with no business near the crime scene, making them "chance witnesses" whose presence was unexplained. The court also noted the witnesses were related to the victims and hostile toward the accused, raising doubts about bias, especially since they were unharmed despite allegedly being at gunpoint. The FIR itself was delayed by over three hours without justification, despite the police station being only 1.5 kilometers away. The court also found the alleged motive and manner of the killing illogical, since the accused spared witnesses who could testify against him.
Given these inconsistencies, the court ruled the prosecution failed to prove guilt beyond reasonable doubt and allowed the appeal, acquitting the accused. This case highlights how Pakistani courts scrutinize witness credibility, delays in reporting crimes, and logical consistency of evidence before upholding
