Taweez Khan V. The State,
PCrLJ 2023 1792 · Balochistan High Court
This case involves an appeal by Taweez Khan, who was convicted and sentenced for the murder of the complainant's son and another person, allegedly killed by firing. He appealed to the Balochistan High Court challenging his conviction.
The court examined the evidence closely and found serious problems with the prosecution's case. First, the complainant was not an eyewitness and learned of the killings from a relative, who was never produced in court or questioned by investigators, even though this relative was clearly important to the case. Courts can treat withholding such a key witness as suggesting the evidence would not have supported the prosecution. Second, there was an unexplained delay of over three and a half hours in filing the police report, raising suspicion that time was used to deliberately decide who to name as culprits. Third, the sole eyewitness refused to identify the accused in court and was declared hostile, with no identification parade ever conducted. Fourth, the mobile phone call records used as evidence were unreliable, not properly verified, and could not even be confirmed as belonging to the accused. Finally, bullet casings found at the scene were never sent for forensic testing, making them unreliable corroborative evidence at best.
Given all these weaknesses, the court ruled that the prosecution failed to prove guilt beyond reasonable doubt, and allowed the appeal, overturning the conviction. This case highlights how courts scrutinize witness credibility, evidence handling, and investigative shortcuts before upholding serious criminal convictions.
