Khaliq Dad V. Nadir Khan and others,

PCrLJ 2023 1276 · Balochistan High Court

This case involved a clash between two tribes, the Mandokhail and Babar, over a disputed piece of land (viala) where one side was building a mosque. The fight involved 25-40 people from each side using cudgels and stones, and people on both sides were injured. Police lodged an FIR, and after investigation, separate criminal cases (challans) were filed against accused persons from both tribes, since each side blamed the other for starting the violence.

In one of these cases, the trial court accepted an application under section 249-A of the Criminal Procedure Code and acquitted the accused before the prosecution had even finished presenting its evidence. The complainant, Khaliq Dad, appealed this acquittal to the Balochistan High Court.

The High Court found this was improper. Although courts can review evidence in acquittal appeals, it noted that acquittals granted early under section 249-A don't carry the same weight as acquittals reached after a full trial. Since these were cross-cases arising from the same incident, the court held that both cases should have been tried side by side by the same court, with judgments announced together. This is because determining who was the real aggressor requires looking at evidence from both sides together, and deciding one case in isolation risks unfair or inconsistent results.

The court partly allowed the appeal, cancelled the acquittal, and sent the case back for trial to continue properly alongside the related case, with both judgments to be delivered simultaneously. This ruling reinforces fair procedure in cases involving rival versions of the same incident.
