Rafaat Shah V. The State,
PCrLJ 2022 Note 39 · Balochistan High Court
This case involves Rafaat Shah, who was convicted by a trial court for killing a man named Muhammad Nawaz by allegedly hitting him on the head with a stone during a quarrel. He was sentenced to ten years' rigorous imprisonment under section 302(c) of the Pakistan Penal Code, along with a compensation order. He appealed this conviction to the Balochistan High Court.
The High Court overturned the conviction and acquitted the appellant, giving him the benefit of the doubt. The judges found multiple serious problems with the prosecution's case. The eyewitnesses, who were close relatives of the deceased, behaved unnaturally - they neither took the injured man to hospital nor informed the nearby Levies Station, despite being right across from it, and instead let the injured man ride home alone on a motorcycle. There was also an unexplained 26-hour delay in filing the police report, even though the deceased had been medically examined within two hours of the incident. Additionally, the medical evidence contradicted the eyewitness account: doctors found only a single swelling injury with no broken skin, while the complainant claimed repeated blows, and the stone allegedly used as the weapon had no blood on it.
The court reaffirmed the important legal principle that even a single reasonable doubt is enough to acquit an accused person - prosecutors don't need multiple doubts to exist. This case illustrates how courts carefully scrutinize witness credibility, conduct, and consistency between evidence types before allowing a serious conviction to stand.
