Ghungar Khan V. The State ,

PCrLJ 2022 Note 32 · Balochistan High Court

This case involves an appeal against a murder conviction. Ghungar Khan and co-accused were accused of killing the complainant's brothers and nephew by stoning them after forcibly catching them, with charges including murder, rioting, and terrorism offences. The Balochistan High Court overturned the conviction and acquitted the appellant.

The court found multiple serious problems with the prosecution's case. First, there was an unexplained delay of over a month in filing the police report, and the complainant's explanation for this delay was found implausible. Second, the three eyewitnesses, all close relatives of the deceased, behaved unnaturally—they claimed to have witnessed the killings but suffered no injuries themselves, made no attempt to intervene or rescue the victims, and even left the bodies at the scene for over a month before they were recovered. Third, the prosecution failed to produce two other named witnesses mentioned in the complainant's initial statement, which the court said suggested their testimony would have contradicted the official story. Finally, there was a direct contradiction between the medical evidence, which showed the victims died from firearm injuries, and the original police report, which only mentioned stoning—with witnesses later dishonestly changing their statements at trial to match the medical findings.

Because of these doubts and contradictions, the court held the witnesses were unreliable and acquitted the appellant, highlighting how delayed reporting, implausible witness conduct, withheld witnesses, and shifting testimony can undermine a criminal case.
