Aurangzaib and another V. The State ,

PCrLJ 2022 853 · Balochistan High Court

This case involved two men, Aurangzeb and Asfand Yar, who were stopped by police at a checkpoint near Sibi while traveling in a car from Quetta. Police found 68 kilograms of baked charas (hashish) hidden in secret cavities of the car's tank and doors. Asfand Yar was driving, while Aurangzeb was a passenger in the front seat. Both were convicted by a trial court under the Control of Narcotic Substances Act and sentenced to over ten years in prison.

On appeal, the Balochistan High Court examined the evidence carefully. It found that the prosecution witnesses, all police officials, gave consistent and credible testimony about the arrest, the recovery location, and the handling of the narcotics, and the defence could not shake their account or show any enmity that might explain a false charge. The court also ruled that a six-day delay in sending drug samples for chemical testing was not fatal to the case, since such time limits are guidance rather than strict law, and there was no evidence of tampering.

However, the court drew a key distinction for the passenger, Aurangzeb. Since the drugs were hidden in the vehicle's structure and not on his person, and there was no evidence he knew about them, merely sitting in the car was not enough to prove guilt. His conviction was overturned, while the driver's conviction was upheld. The case highlights that physical presence alone cannot establish criminal responsibility—actual knowledge or control over contraband must be proven.
