Meeran Bakhsh alias Matru V. The State ,
PCrLJ 2022 630 · Balochistan High Court
This case concerns Meeran Bakhsh alias Matru, who along with another person was accused of murdering a woman named Mst. Razul, as recorded in a 2015 FIR. Because the accused had absconded and could not be arrested, the Anti-Terrorism Court at Dera Allah Yar declared them proclaimed offenders and, without a full trial, convicted them under Section 21-L of the Anti-Terrorism Act, 1997, which punishes a person for evading arrest or court proceedings. They were sentenced to five years' imprisonment with a fine.
On appeal, the Balochistan High Court found serious legal flaws in this conviction. No formal charge had ever been framed against the appellant under Section 21-L, no evidence was recorded to prove the elements of that offence, and the trial court had not even determined whether the absconding was intentional. The High Court held that convicting someone under this provision requires following proper trial procedure, including giving the accused a fair opportunity to be heard, as guaranteed by Articles 9 and 10(1) of the Constitution. Convicting someone in their absence without these safeguards amounted to condemning them unheard.
Relying on a Supreme Court precedent, the High Court declared the conviction illegal, allowed the appeal, and sent the case back to the trial court to properly frame charges and conduct a lawful trial. The judgment reinforces that even proclaimed offenders are entitled to fair trial protections before being convicted and punished.
