Syed Mohsin Ali V. The State through Deputy Prosecutor General (DPG), National Accountability Bureau (NAB), Balochistan ,
PCrLJ 2022 549 · Balochistan High Court
Syed Mohsin Ali was convicted by an Accountability Court in Quetta for running a housing scheme called "Pine Town Housing Scheme" and allegedly defrauding members of the public who paid money for plots that were never allotted or handed over. He was sentenced to five years' imprisonment, a heavy fine, and disqualification from holding public office or getting bank loans for ten years.
On appeal, the Balochistan High Court overturned the conviction. The court found that out of 412 people who had booked plots, only ten testified, and two of them admitted they had not even paid the full amount owed. The investigating officer himself admitted the scheme failed because of civil litigation between the accused and the original land seller, not fraud. The court held that to prove corruption under the National Accountability Ordinance's provision on defrauding "the public at large," the prosecution must show the fraud affected the public at a broad, macro level—not just a small handful of individuals. Ten witnesses did not meet that threshold.
The court also explained that criminal breach of trust and cheating require proof that the accused intended to deceive from the very beginning, and that merely taking investment money for a business venture that later failed does not automatically amount to criminal breach of trust. It concluded this was essentially a civil contractual dispute, not a criminal case, and set aside the conviction and sentence. This case clarifies the high bar prosecutors must meet when alleging large-scale public fraud under accountability laws.
