PcrLJ 2022 52 · Balochistan High Court

This case involved a criminal appeal against the acquittal of a man accused of committing an unnatural offence (sodomy) under Section 377 of the Pakistan Penal Code, allegedly against the complainant's young nephew. The complainant's aunt, Rifat Bibi, filed an appeal challenging the trial court's decision to acquit the accused.

The Balochistan High Court dismissed the appeal on two grounds. First, it was filed late. The law required such appeals to be filed within thirty days of the trial court's judgment, but this appeal was filed fifty-three days later, and no application was made to excuse the delay, nor was the delay properly explained.

Second, even looking at the merits, the court found the acquittal was justified. There was no eyewitness to the alleged act, and the medical evidence was inconclusive. The doctor's examination did not follow proper medical procedure for such cases, found no real injuries, and could not confirm penetration, which is legally required to prove the offence. Forensic test results on clothing samples were never produced in court. The court also noted both the accused and victim were very young children. Given these gaps, the court held that an acquittal carries a presumption of innocence that can only be overturned if the original decision was clearly unreasonable, which was not the case here. The appeal was dismissed, reinforcing how strictly courts require proof before overturning acquittals.
