Sheikh Arsalan V. The State,

PCrLJ 2022 1308 · Balochistan High Court

This case is about a man named Sheikh Arsalan who was convicted by a trial court in Quetta for murder (qatl-i-amd) and robbery, after being accused of snatching a mobile phone and shooting a man named Najeebullah, who later died of his injuries. The trial court sentenced Arsalan to life imprisonment plus additional jail time and fines.

Arsalan appealed to the Balochistan High Court, arguing his conviction was flawed. The High Court agreed. It found several serious problems with how the trial was conducted. First, the trial court never properly examined or made findings about how the victim actually died. Second, when Arsalan was questioned under section 342 of the Criminal Procedure Code (a step where the accused must be confronted with the evidence against him), he was never asked about key evidence like the recovered pistol or the allegedly snatched mobile phone, even though the trial court used this evidence to convict him. Third, the witnesses who witnessed the recovery of the weapon and phone were never properly examined in court, and the actual case property (weapon and phone) was never formally presented as evidence.

Because of these fundamental procedural failures, the High Court set aside the conviction and sentence entirely and sent the case back to the trial court to be decided fresh, this time properly examining the recovery witnesses and evidence. The case highlights how strict evidentiary and procedural fairness rules in criminal trials must be followed before someone can be convicted.
