Saeed Ahmed V. The State,

PCrLJ 2022 1018 · Balochistan High Court

This case involved Saeed Ahmed, who was stopped while driving an Alto car at a police checkpoint in Sibi. Police searched the vehicle and found 8,000 grams of charas (hashish) concealed in secret cavities. He was charged and convicted under section 9(c) of the Control of Narcotic Substances Act, 1997, and sentenced by the trial court to ten and a half years of rigorous imprisonment plus a fine. He appealed to the Balochistan High Court.

The High Court examined the evidence, including testimony from the arresting officer, witnesses to the recovery, the officer who stored the drugs in police custody, the officer who transported the samples to the forensic laboratory, and the investigating officer. The court found their statements consistent and credible, noting that the sample had been sent for forensic testing within 72 hours, ruling out tampering, and the lab confirmed it was charas. The defense argued that no private witnesses were included in the search, only police officials, which would normally be required under section 103 of the Criminal Procedure Code. The court rejected this, pointing out that narcotics law specifically excludes that requirement.

The court also relied on precedent holding that whoever is driving a vehicle is responsible for whatever is found inside it, since the driver controls the vehicle. Finding no reason to doubt the prosecution's case, the court upheld the conviction and dismissed the appeal. The case reinforces that drivers can be held liable for narcotics found in their vehicles, and that police-only searches are valid in drug cases.
