Jahanzaib V. The State,
PCrLJ 2021 Note 2 · Balochistan High Court
This appeal concerns a man convicted by the Anti-Terrorism Court in Turbat for allegedly supplying goods to members of a banned organization, the Baloch Liberation Army. He had pleaded guilty to charges under the Anti-Terrorism Act, and the trial court convicted and sentenced him to prison terms and fines based solely on that guilty plea, without a trial.
The Balochistan High Court found serious problems with how this conviction was obtained. The accused had no lawyer, and the trial court never asked him whether he wanted one. There was no record showing he had been given copies of key documents, such as the FIR and witness statements, which the law requires be provided to an accused person before trial. The court also found that the charge itself was not properly framed as required by law, and that it failed to spell out the essential elements of the specific offenses he was accused of.
The High Court held that when someone pleads guilty, the charge must be read and judged strictly, and a conviction cannot stand if facts necessary to prove the offense are missing, even if the accused admits guilt. It also clarified that while someone who pleads guilty generally cannot appeal their conviction, higher courts still retain the power to examine whether that conviction was lawful.
As a result, the court set aside the conviction and sentence and sent the case back for a fresh trial, ensuring the accused gets a fair process, including proper legal representation and access to case documents.
