Muhammad Din V. The State,

PCrLJ 2021 839 · Balochistan High Court

This case involved a man, Din Muhammad, who was accused of murdering his two wives inside his home in Kalat, Balochistan, allegedly along with several co-accused, over accusations of infidelity ("siyakari"). The trial court convicted him under section 302(b) of the Pakistan Penal Code (murder) read with section 34 (common intention), sentencing him to life imprisonment on two counts plus compensation to the victims' families. He appealed to the Balochistan High Court.

The High Court found serious problems with the prosecution's case. The FIR was lodged 12 hours after the incident by someone who had not witnessed it, raising suspicion of manipulation. The only supposed eyewitness, the appellant's third wife, only saw the bodies afterward and did not accuse her husband; she was later declared a hostile witness. The prosecution relied heavily on a confession recorded by a magistrate nine days after arrest, but the magistrate failed to follow proper legal procedure, did not warn the accused about his rights, did not check for signs of torture, and gave no time for reflection—making the confession legally unreliable, especially since it was later retracted. Medical evidence didn't clearly support the prosecution's version, the alleged motive was never proven, and the murder weapon was neither recovered from the accused nor tested at a forensic lab.

Given these serious gaps, the court ruled the prosecution failed to prove guilt beyond reasonable doubt and acquitted the appellant, overturning the conviction. The case highlights how courts must caref
