PCrLJ 2021 719 · Balochistan High Court

This case involved two men accused of robbing and murdering a police official, with the main evidence being a dying declaration allegedly made by the victim identifying the attackers before he died. The trial court had convicted the accused, but they appealed to the Balochistan High Court.

The High Court overturned the conviction, finding serious doubts throughout the prosecution's case. First, the court questioned why the FIR was not registered based on the victim's own oral report at the crime scene, and noted that the police officer supposedly present when the dying declaration was made never had his statement recorded. Second, the timeline did not add up: the shooting occurred at 8:45 pm, but the body reached the hospital by 9 pm, leaving an implausibly short window for the dying declaration to have been made and relayed. Third, medical evidence showed the victim's injuries were to vital areas of the skull and abdomen, making it doubtful he could have spoken at all. Additionally, the recovered motorcycle could not be reliably linked to the accused's house, and bullet casings found at the scene did not match the number of wounds and were never forensically tested.

The court emphasized that even a single serious doubt is enough to acquit an accused, as a matter of right rather than mercy. This judgment underscores how courts scrutinize dying declarations and circumstantial evidence carefully before upholding murder convictions, especially when timelines and corroboration are weak.
