Muhammad Ashraf V. The State,

PCrLJ 2021 586 · Balochistan High Court

Muhammad Ashraf was convicted under Section 489-F of the Pakistan Penal Code, which deals with dishonestly issuing a cheque that later bounces. The complainant, a manager at a trading company, claimed Ashraf had entered into a business partnership with the company, accumulated a large outstanding debt, and issued three cheques to settle it that were later dishonoured due to insufficient funds. Both the trial court and the appellate court convicted Ashraf, sentencing him to three years in prison and a fine.

The Balochistan High Court overturned the conviction on revision. It found serious weaknesses in the prosecution's case: the complainant produced no written partnership agreement or any documents proving the business relationship existed, and could not give basic details about it. The complainant admitted he himself filled in the cheque amounts, undermining the claim that the accused had intentionally issued them. There was also an unexplained six-month delay in filing the FIR, and evidence suggested the complaint was filed only after legal consultation. Additionally, the actual owner of the trading company and his brother were never produced as witnesses, even though their testimony would have been crucial to prove the alleged partnership and debt.

The court held that mere dishonouring of a cheque is not automatically a crime unless dishonest intent is proven. Given these gaps and doubts, the court acquitted Ashraf, setting aside both lower court judgments. The case underscores that cheque-dishonour convictions require solid proof of intent and underlying transactions, not just an unpaid cheque.
