Ghulam Ali V. The State,

PCrLJ 2021 438 · Balochistan High Court

This case was about who should get custody of a truck that had been intercepted carrying a large quantity of narcotics, after the driver who was initially convicted was ultimately acquitted on appeal.

Under Pakistan's Control of Narcotic Substances Act, 1997, vehicles used to transport drugs can be confiscated by the court. However, the law also says a vehicle cannot be confiscated unless it is proved that the owner knew it was being used to commit the crime. The trial court had ordered the truck confiscated, but the appellant, who claimed ownership (or co-ownership) of the truck, challenged that part of the judgment, arguing he was never prosecuted and no evidence showed he knew about the drug smuggling.

The Balochistan High Court agreed with the appellant. It found that the case record was silent on whether the prosecution ever investigated or proved that the truck's owner had knowledge of the narcotics being transported. Since the burden of proving such knowledge lies on the prosecution, and that burden was not met, confiscation could not stand.

The court allowed the appeal, set aside the confiscation order, and sent the case back to the trial court to release the truck, subject to verifying actual ownership through the vehicle registration authority. This case matters because it reinforces that innocent vehicle owners should not automatically lose their property just because it was misused by someone else without their knowledge.
