The State through Prosecutor General Balochistan V. Muhammad Ashfaq,
PCrLJ 2021 186 · Balochistan High Court
This case involved an appeal by the State of Balochistan against the acquittal of Muhammad Ashfaq, who had been charged under the Arms Ordinance, 1965 for possessing an unlicensed pistol. The allegation was that police recovered a TT pistol, magazine, and two live rounds based on Ashfaq's pointing out the location while he was in custody in a separate murder case.
The trial court had acquitted him, and the State challenged this acquittal before the Balochistan High Court. The High Court upheld the acquittal, finding serious problems with the prosecution's evidence. The weapon was allegedly recovered from a running water drain twenty-five days after the murder it was supposedly used in, yet a lightweight bullet casing had supposedly stayed put in flowing water that long—something the court found implausible. The recovery also happened in a populated area where independent witnesses could easily have been brought in to verify the process, but police made no such effort. There were also unexplained delays in sending evidence for forensic examination. Additionally, Ashfaq had already been acquitted in the original murder case this weapons charge stemmed from.
The court reaffirmed key legal principles: even a single significant doubt in the prosecution's case entitles the accused to benefit of the doubt as a matter of right, not mercy. It also stressed that once a person is acquitted, they gain a "double presumption of innocence," meaning appellate courts need strong, compelling evidence to overturn such a verdict. Finding no such evidence here, the court dismissed the State's appeal
