Nozo V. The State,
PCrLJ 2021 1729 · Balochistan High Court
This case involves Nozo, who was arrested on 10 February 2020 and accused of possessing an improvised explosive device and other explosive materials. He was tried under the Explosive Substances Act and the Anti-Terrorism Act, and convicted by a Special Judge of the Anti-Terrorism Court. He appealed to the Balochistan High Court.
The High Court overturned the conviction and acquitted him, giving him the benefit of the doubt. The judges found multiple serious flaws in the prosecution's case: the FIR was lodged eight hours after the alleged incident with no explanation, raising suspicion of manipulation; the recovered explosives were not sealed at the scene but six hours later; no one recorded how much explosive material was actually recovered; the sample sent for forensic testing arrived eighteen days late with no explanation, and the officials responsible for its custody and transmission were never produced as witnesses; and crucially, the law required prior government permission (sanction) before prosecuting someone under the Explosive Substances Act, which was never obtained.
Because sanction is a mandatory legal requirement, its absence made the entire trial void. Combined with the unexplained delays and broken chain of evidence, the court concluded the prosecution had failed to prove guilt beyond doubt.
This case highlights how procedural safeguards—prompt FIR registration, proper evidence handling, and legal permissions—protect individuals from wrongful conviction, even in serious terrorism-related cases.
