PCrLJ 2021 1598 · Balochistan High Court
This case was decided by the Balochistan High Court on a petition filed by Rakhshanda Jamal, who was seeking reinvestigation of a case involving the alleged abduction of her two daughters. The accused had already been tried: police had completed their investigation, submitted the charge sheet, the trial court framed charges, and prosecution evidence had already been recorded. At that late stage, while the case was awaiting defense evidence, the petitioner asked the trial court to order a fresh investigation by the Crimes Branch. The trial court rejected this request, and she challenged that rejection before the High Court.
The High Court dismissed her petition, holding that the legal provisions she relied on (sections 22-A and 22-B of the Criminal Procedure Code) exist to give citizens a remedy against police failures, such as refusal to register a case or improper investigation. However, these provisions are not meant to be used to interfere once a case has already gone to trial and reached an advanced stage. The court noted that reinvestigation is permissible before a case is finally decided, but not as a tool to disrupt ongoing trial proceedings, especially when no new facts had been presented to justify it.
This ruling matters because it clarifies the limits of using police-oversight provisions to interfere with judicial proceedings already underway, reinforcing that courts, not reinvestigation requests, should determine the outcome once trial has progressed significantly.
