Chairman Nab through Prosecutor General Accountability, NAB HQ Shahrah-e-jumhuriat, G-5/I, Islamabad V. Zahoor Taj and another,
PCrLJ 2021 1420 · Balochistan High Court
This case involved a corruption reference filed by the National Accountability Bureau (NAB) against Zahoor Taj and others, accused of staging a fake tendering process for a government contract in connivance with department officials, amounting to corruption under the National Accountability Ordinance, 1999.
Before any prosecution evidence was recorded, the accused filed an application under Section 265-K of the Criminal Procedure Code, asking the trial court to acquit him early in the proceedings. The Accountability Court accepted this application and acquitted him without hearing any evidence. NAB challenged this acquittal before the Balochistan High Court.
The High Court held that while there is no time limit for filing such an early-acquittal application, fairness requires that the prosecution be given a genuine opportunity to present its evidence before a case is decided. The court noted that other co-accused were still facing trial on the same evidence, so it was improper for the trial court to make findings on credibility and reliability of evidence at such an early stage, effectively deciding the case without hearing the prosecution.
The High Court ruled that in corruption and misappropriation cases especially, courts must proceed with extreme caution and should not hastily acquit the accused without a full trial. It set aside the acquittal and sent the case back to the trial court for a proper trial, with evidence to be recorded before any decision is made. This judgment reinforces that corruption cases deserve thorough scrutiny rather than premature dismissal.
