Ghulam Dastagir alias Dodo V. The State and another,

PCrLJ 2021 1390 · Balochistan High Court

This case concerns Ghulam Dastagir, who had been sentenced to death for murder, a sentence later reduced to life imprisonment by the Balochistan High Court and upheld by the Supreme Court. While in prison, he pursued education and, on that basis, asked the court to direct prison authorities to grant him special remission in his sentence, specifically the remission announced by the President of Pakistan under Article 45 of the Constitution.

The government pointed out that presidential notifications granting such special remissions explicitly excluded certain categories of prisoners, including those convicted of murder, espionage, terrorism, kidnapping, and similar serious offences. Since the petitioner was convicted of murder, he fell into the excluded category and was not entitled to this particular remission, even though he had already received other remissions available to ordinary prisoners.

The Balochistan High Court agreed with the government. Relying on a Supreme Court ruling, it held that the President can lawfully classify prisoners and withhold remission benefits from those convicted of heinous crimes, as this distinction is reasonable and not discriminatory under the Constitution. Since such prisoners are not in the same position as ordinary convicts, excluding them from special remission does not violate equality rights.

The court therefore dismissed the petition, confirming that prisoners convicted of murder and similar serious crimes cannot claim special presidential remissions when they are expressly excluded by the relevant notifications.
