Muhammad Essa Rooshan V. The State,

PCrLJ 2021 1342 · Balochistan High Court

This case concerns a petition to quash a criminal case (FIR) registered against Muhammad Essa Rooshan at Pishin police station. The FIR accused him of making speeches during a political protest that allegedly used inappropriate language against state institutions and security agencies, provoking public sentiment against the state. He was charged under several sections of the Pakistan Penal Code dealing with sedition-type offences, including promoting hatred between groups and condemning the state, along with a provincial sound-system regulation law.

The Balochistan High Court quashed the FIR. The key reason was procedural: under section 196 of the Criminal Procedure Code, courts cannot take cognizance of offences like these unless a formal complaint is filed with the authorization of the Federal or Provincial Government, or an officer specifically empowered to do so. In this case, the FIR was simply lodged by a police sub-inspector on his own initiative, without any such government sanction. The court held this requirement is mandatory, not optional, and its violation made the entire investigation and proceedings legally invalid.

This matters because it reinforces that certain serious offences against the state cannot be prosecuted through ordinary police action alone—government oversight is required to prevent misuse of these laws, particularly against political speech and protest. The judgment highlights the court's role in using its inherent powers sparingly, but decisively, to stop abuse of legal process when mandatory procedures are ignored.
