Hayatullah V. Deputy Inspector General of Balochistan Police, Quetta and 3 others,

PCrLJ 2021 1079 · Balochistan High Court

would like to clarify the law applicable to this case. Section 154, Cr.P.C. is a mandatory provision. When information about a cognizable offence is given to the officer in charge of a police station, he is bound to record it in writing in the prescribed register and cannot use his discretion to refuse or delay registration. Section 157, Cr.P.C. only comes into operation after a report has properly been registered under section 154; it cannot be used as a substitute for registration, and merely noting the complaint in the daily diary (roznamcha) and conducting an inquiry does not satisfy the law's requirement.

In this case, the complainant alleged that he had purchased a car which was later found to be stolen and that the documents relating to it were forged. Instead of immediately registering an FIR under section 154, the SHO first recorded the complainant's statement and conducted an inquiry under section 157(2), and only after that registered the FIR nearly three weeks later.

The petitioner asked the High Court to declare this inquiry illegal and to quash the FIR on that basis. The court explained that quashing an FIR is an extraordinary remedy, available only where the FIR discloses no cognizable offence, was registered without lawful authority, or where a civil dispute has been dressed up as a criminal case. Courts generally do not interfere at the investigation stage, since investigating officers have their own powers to conclude whether evidence supports prosecution, and an accused can seek acquittal later during trial if the evidence is insufficient.
