Mirwise V. Mohib-Ur-Rehman, SI/SHO Police Station Saddar, Loralai and another,

PCrLJ 2021 1032 · Balochistan High Court

This case is about how courts should determine whether a criminal accused is a juvenile or an adult when the evidence on his age conflicts. The petitioner, Mirwise, was facing charges and claimed to be a minor at the time of the alleged offence, relying on his birth certificate and school leaving certificate, which showed his date of birth as 2000, making him under 18. However, NADRA family tree records showed a different date of birth, in 1998, suggesting he was already an adult. The trial court rejected his request to transfer the case to a juvenile court and also refused his later application to have his age determined through a medical board, relying instead on the NADRA record. This refusal was upheld by the Sessions Court on appeal.

The Balochistan High Court disagreed. It held that when there is a genuine conflict between documents about a person's age, NADRA records alone are not conclusive proof, since they are based on information supplied by individuals rather than independent verification. The court explained that under the Juvenile Justice System Act, 2018, whenever a real question arises about an accused's age, the trial court must conduct a proper inquiry, which should include examining documents, witness statements, and especially medical evidence such as an ossification test, since medical opinion is preferred when documents conflict.

The court therefore set aside the lower courts' orders and sent the case back to the trial court, directing it to conduct this inquiry and determine the petitioner's correct age through a medical board. This decision matters because it protects the rights of young accused persons to be properly treated as juveniles when their age is genuinely in dispute.
