Abdul Qayyum and another V. Government of Balochistan through Chief Secretary and 2 others,
PCrLJ 2020 960 · Balochistan High Court
This case involved a man, Abdul Qayyum, who was placed under preventive detention by the Balochistan government under Section 3(1) of the Balochistan Maintenance of Public Order Ordinance, 1960. He was first detained for 30 days by the Deputy Commissioner of Loralai, and this detention was later extended for another 30 days by the Additional Chief Secretary (Home), Government of Balochistan. The stated reasons were that he was considered a potential threat to public safety, likely to create a law-and-order situation, and was allegedly provoking people against the State. A second petitioner, initially also detained, was released after completing his 30-day detention and did not pursue the case further.
The Balochistan High Court examined whether the government's satisfaction in ordering the detention was based on real evidence or was arbitrary. The court held that such satisfaction must be objective, backed by concrete material, not just vague or general assertions. It found that the grounds given for detaining Abdul Qayyum were generic and unsupported by any actual evidence.
As a result, the court declared the detention orders null, void, and without legal effect. This ruling matters because it reinforces that no citizen's liberty can be restricted without lawful justification, and that courts have the power to review and strike down preventive detention orders that lack proper evidentiary basis, safeguarding fundamental rights under the Constitution.
