Bilal V. Abdul Karim and 6 others,
PCrLJ 2020 843 · Balochistan High Court
This case is about a man named Bilal who claimed he owned agricultural land that had been illegally taken over by Abdul Karim and others while Bilal was living abroad. He filed a complaint under Pakistan's Illegal Dispossession Act, 2005, a special law meant to criminally punish land grabbers, people who forcibly or unlawfully seize property without any legal title. The trial court dismissed his complaint, finding the dispute was essentially civil in nature, not criminal land-grabbing. Bilal challenged that dismissal before the Balochistan High Court.
The High Court first addressed a technical objection: since the Act does not specifically mention a right of appeal or revision, could Bilal even challenge the order this way? The Court clarified that the law's silence didn't eliminate appeal rights, because Section 9 of the Act applies the general Criminal Procedure Code to such cases, allowing revision petitions.
On the merits, however, the Court ruled against Bilal. It held that the Illegal Dispossession Act only applies in specific situations, such as when the accused has no title to the land, took it by force, acted outside legal process, or belongs to a land-grabbing gang. Since Bilal failed to show his case fit this criteria, and the matter appeared to be a civil property dispute, the Court upheld the trial court's dismissal and rejected his revision petition. The judgment reinforces that civil disputes cannot be disguised as criminal cases under this special law.
