Shafi Muhammad V. Sessions Judge, Lasbela at Hub and 3 others,
PCrLJ 2020 711 · Balochistan High Court
This case concerns an accused person's right to present defense evidence during a criminal trial. The petitioner, Shafi Muhammad, had asked the trial court to summon a representative of a company called Gatron to verify an attendance sheet as part of his defense. The trial court rejected his application, and when he challenged this before the Sessions Judge in revision, that court also upheld the rejection. He then approached the Balochistan High Court.
The High Court ruled in his favor. It held that under Section 265-F of the Criminal Procedure Code, once an accused expresses intent to present defense evidence, the trial court is legally obligated to allow it—the word "shall" in the law does not give judges discretion to refuse. A court can only deny such a request if it believes the accused is trying to cause delay or defeat justice, and even then, it must record specific reasons in writing.
The High Court found that the lower courts had no valid grounds to refuse the petitioner's request, since the authenticity of the disputed document could only be properly assessed after hearing the witness testify. By denying this opportunity, the trial court had violated the petitioner's right to a fair trial guaranteed under Article 10-A of Pakistan's Constitution.
The High Court set aside both lower court orders and directed the trial court to summon the company representative as requested. This judgment reinforces that courts must respect an accused person's fundamental right to present a full defense.
