Obaidullah and others V. The State and others,

PCrLJ 2020 637 · Balochistan High Court

This Balochistan High Court case involved multiple appeals arising from a murder trial. Two men, Zubair Ahmed and Obaidullah, were convicted for killing a person: Zubair was sentenced to death, and Obaidullah to life imprisonment. A third accused had been acquitted by the trial court, and the complainant filed a petition seeking harsher punishment, while the acquitted man's release was challenged separately.

There was no direct evidence of the murder. The case relied on circumstantial evidence, including the accused's disclosures leading to recovery of the murder weapon, forensic ballistic reports confirming the weapon matched crime scene evidence, and confessions recorded by a judicial magistrate. Although the confessions were later retracted, the court found them voluntary, truthful, and corroborated by other evidence, so they could still support conviction.

The court upheld the guilty verdicts against both men, finding the evidence excluded any reasonable possibility of innocence. However, it reduced Zubair's death sentence to life imprisonment, since the confession had been recorded six or seven days after arrest—an irregularity urging caution—and because the crime appeared to have been committed under the influence of an absconding co-accused with whom he had a personal involvement.

Regarding the acquitted man, the court upheld his acquittal since the only evidence against him was an extra-judicial confession made while in police custody, which is not legally admissible.

This judgment clarifies important principles on when retracted confessions can support convictions and how courts weigh circumstantial ev
