PCrLJ 2020 594 · Balochistan High Court
This case involved two individuals, including a company's Managing Director, who were convicted for manufacturing and selling an unregistered medicine called Skysim Fort Syrup, which was found to contain allopathic (pharmaceutical) ingredients rather than being purely herbal as claimed. A Drug Inspector in Quetta had collected a sample from a medical store, which government testing confirmed contained an unregistered allopathic ingredient (Aluminum). Following a review by the Provincial Quality Control Board, the accused were prosecuted and convicted by the trial court under the Drugs Act, 1976, receiving one year's imprisonment and fines.
On appeal, the accused argued that the Drug Inspector had acted outside her territorial jurisdiction and that the product was homeopathic, not subject to the Drugs Act. The Balochistan High Court rejected both arguments. It found that the inspection took place within the officer's proper jurisdiction, so no special permission was needed. It also noted that the accused failed to provide any documentary proof that the drug was registered, while the prosecution presented solid evidence, including the government analyst's report, to prove the drug was unregistered and contained allopathic substances. اپیل میں ملزمان کا مؤقف تھا کہ ڈرگ انسپکٹر نے اپنے علاقائی دائرہ اختیار سے باہر جا کر کارروائی کی تھی، اور یہ کہ مذکورہ
